A regular meeting of the Board of Adjustment was held in the Municipal Complex at 7:30 p.m.

The Board’s Professionals were sworn in.

BA-2609- Mulvihill

Walter Mulvihill was sworn in. He has constructed a vinyl board fence 6ft. high along the property line at Frede Drive to replace an already existing fence. The fence was placed 3.6ft from the property line on Frede Drive where a 30ft setback is required. The applicant constructed the fence with no permit. He is requesting to keep the fence in the same location for the safety of his children.

The Board asked the applicant if he would be willing to plant shrubbery along side the fence as a cover. The applicant agreed.

The existing shed on the property was removed.

Public portion closed.

Factual Findings

Ms. Lau- The applicant replaced a 6ft wood fence with a 6ft. vinyl fence at 3.6ft from the property line on Frede Drive. The required setback is 30ft. The applicant is requesting the fence for the safety of his children. The applicant will have to obtain a permit for the fence.

A motion was made to approve case BA-2609- Walter Mulvihill. It was moved by Ms. Iannarone and seconded by Mr. Brando. All other Board members voted AYE.

BA-2582- Clayton

Nicholas Montenegro was present to represent the applicant.

Michael Melillo was sworn in. (architect) The existing home is not a safe structure. It presently does not meet building codes. The home is a Chalet type of structure and will have solar panels for heat. The size of the home is similar to others in the area. It will be constructed at 18.07ft. from the front property line which is the same as other homes on the block. The bay windows are 2ft beyond that measurement. Parking is adequate on the site.

Walter Scharfenberg was sworn in. The variances requested for this application are:

Lot Area- 4656SF existing. 7500SF required

Lot Width- 50ft. existing, 75ft. required

Front Setback- 15.57Ft. proposed, 18.07 existing, 25ft. required.

Side Setback- 5.0ft proposed, 4.62ft. existing, 6ft. required

Side Setback,Combined- 14.0ft. proposed, 13.61ft. existing, 15ft. required

Lot Coverage- 32.1% proposed, 29.7% existing, 30% required.

The application has not been submitted to CAFRA for their approval yet.

A-4-Letter from Sean Kinnevy stating the property owned by Mr. Clayton was approved

for a legal two family home.

Mr. Clayton does not own any adjoining property. He agreed to abolish the two family home approval. Mr. Cantoli stated that when the existing home is demolished the two family home approval will no longer exist.

Kathryn Erickson was sworn in. Her mother is a neighbor of the applicant. She stated that the home fit into the area and was not a detriment to the neighborhood.

Factual Findings

Mr. Chandler- The applicant is replacing a home on an undersized lot. The applicant must comply with all the conditions in Mr. Owen’s report dated December 11, 2007. The existing home does not meet the current codes. The new home will meet all the current codes. It will have solar panels. All the homes on the block have the same front setback of 18.07 ft. The applicant will apply for a CAFRA permit. No detriment to the Master Plan or Zoning Plan. No objectors present at the meeting.

A motion was made to approve case BA-2582- Clayton. It was moved by Ms. Iannarone and seconded by Ms. Lau. All other Board members voted AYE.

Recess: 8:35 Meeting resumed: 8:45 p.m.

BA-2613- Nini

Michael Ehlers was present to represent the applicant.

Richard Grasso was sworn in. (architect) Mr. Grasso designed the original home for the applicant and is now requesting a variance from side yard setbacks, side yard combined setbacks and lot coverage requirements to complete construction of a three level four bedroom home with a detached two car garage.

The variances requested are:

Front Setback- 17.07ft (garage) proposed, 20ft. required

Side Setback, Each- 2.9ft (west) proposed, 5ft. required

Side Setback, (each) -3.1ft. (east), 5ft. required

Side Setback, Combo- 6.0ft. proposed, 12ft. required

Max. Bldg/Lot Coverage- 38.5% proposed, 35% required

Jeffrey Carr was sworn in. (engineer) The home and the garage are already constructed. The garage was built with an overhang of 3ft. where 18” is allowed. This will also require a variance. The Board questioned whether the applicant had intentions of constructing the covered walkway and wrap around porch when the home was built. Also the covered porch which leads to the mud room.

There is adequate parking on the site and the applicant has obtained CAFRA approval.

Richard Wonsaon was sworn in. (builder) He stated that the pilings for the walkway were installed at the same time as the foundation. The pilings had to be installed whether the applicant had the proposed raised walkway or a walkway closer to the ground.

Kevin Nini was sworn in. He stated that he was requesting the raised walkway trellis for better use for the entrance to the rear of the home.

Mr. Chandler- The applicant must conform with all the conditions in Mr. Owen’s report . The garage is located 17.7ft. from the property line where 20ft. is proposed. The building department overlooked these measurements at the time of inspection. The applicant is requesting the walkway trellis for better use for the entrance to the rear of the home. The applicant proved special reasons. No objectors were present. The covered porch to the mud room is also approved.

A motion was made to approve case BA-2613- Kevin Nini. It was moved by Mr. Brando and seconded by Mr. Marchetti. All other Board members voted AYE.

A motion was made to approve the Resolution as posted for Case BA-2570- 515 Brick Blvd.-Top Tomato. It was moved by Ms. Iannarone and seconded by Mr. Chandler. Mr. Liberatore, Mr. Chandler, Ms. Iannarone, Mr. Mercer, Mr. Brando and Mr. Rentschler voted AYE. Ms. Lau and Mr. Marchetti were ineligible. Mr. Pannucci was absent.

A motion was made to approve the Resolution as posted for Case BA-2160- Paul & Angela Mastroserio. It was moved by Ms. Iannarone and seconded by Mr. Chandler. Mr. Liberatore, Mr. Chandler, Ms. Iannarone, Mr. Marchetti, Mr. Mercer and Mr. Rentschler voted AYE. Mr. Brando and Ms. Lau were ineligible.. Mr. Pannucci was absent.

The meeting adjourned at 10:30 p.m.
